Part 1:

Part II:
1. You are the HR manager in the City Manager's office. You have been presented with a case that involves the following facts:
* A 12 year veteran employee has been recently disciplined for several
policy violations including attendance, conduct unbecoming, work performance issues, and failure to meet work deadlines.
* This employee was suspended without pay for 25 working days.
* While out on suspension another employee discloses that this employee
has been going through some personal issues and believes he may be using
substances.
* The Town Manager has recently indicated that he wants to make an
example of this employee as several other staff have been slacking in similar
areas.
* The union has filed for arbitration.
Given the facts and circumstances of this case what recommendation do you
present to the Town Manager on how to proceed and why?
2. Discuss negotiation techniques that you would utilize during any
collective bargaining process. Be sure to detail what the technique is and give at least one example of how you would utilize it.
3. During the course of an employee workplace violence investigation, at a private company, you are presented with the following:
* The victim in this case wants to drop the case entirely stating that
he was mistaken about what was said and the intent.
* Another employee comes to one of your staff and indicates that he
overhead what sounded like a threat to the victim that "he better not go forward with his testimony during the investigation or his life will be at risk".
* Your IT department has reviewed the employee's computer and has
found little evidence other than the fact that the email account has been
deleted and cleaned out. There was one email left behind to the victim that
says "death" in the subject line but there is no text to the email.
* Prior to your investigatory interview the union has called you and
indicated that the employee will not respond to questions due to self
incrimination concerns
Given the facts and circumstances listed above what issues and concerns do you see with this case and how would you proceed?
4. You are the chief negotiator in contract negotiations that involves management and the largest employee union. Your boss has come to you and stated due to the current economic conditions he is prepared to offer zero salary increases across this contract. Given this fact, what other tactics may you utilize to get a contract successfully completed? How will you deal with a union membership that is anticipating a raise?
5. Review recent union activity in the news. Where do you see future issues and challenges that unions face in the public sector vs. the private sector? If you were advising union leadership on future plans of action what would you suggest?
